HIGHWAY DESIGN LIABILITY Historically, the government had immunity from tort liability for such things as highway design. However, this changed in Arizona with Stone v. Arizona Highway Commission, 93 Ariz. 384, 381 P.2d 107 (1963). While Arizona Courts consistently hold that Arizona and local government units are not the insurers of public safety, they do have a duty to design, repair, and maintain streets and highways so as to make and keep them reasonably safe for travel. This extends to the reasonable care required for design, construction, repair, and maintenance of the roads and related curbs, sidewalks, signs, signals, and barricades. In addition, the government has a duty to remove dangerous obstructions on the roadway when it has notice of them. |
