AVIATION/AIRPLANE ACCIDENTS Operation of aircraft is extensively regulated by Federal law as well as Arizona law. Unsafe practices are prohibited, such as low level flight, acrobatic/trick flying, and dropping objects from an airplane. Flying while under the influence of drugs or alcohol is strictly prohibited, as is permitting someone else to operate your aircraft when that person is under the influence is also prohibited. Careless operation of aircraft is also banned, and similarly provides a basis in negligence for making a claim for damages. Violations of aviation safety regulations, either federal or state, may support a negligence per se claim (that violation of the safety regulation equates to automatic negligence). Under Arizona law, the pilot or his/her employer are legally liable for damages resulting to persons or property, which are caused by the pilot’s negligence, either in operating the aircraft or in instructing someone else in operating the aircraft. |
