AUTO ACCIDENTS

Auto accidents are usually controlled by the general law of negligence.  Negligence is breach of a duty owed to another person (such as to drive your vehicle using reasonable care for the safety of others).

Auto accidents often involve a violation of some type of traffic law.  If the evidence indicates that a person has violated a traffic law of the State of Arizona , that person is negligent.  This is called “negligence per se.”  Examples of this are excessive speed, failure to yield to a pedestrian in a crosswalk, driving over the center line, failing to signal a turn, suddenly decreasing your speed unreasonably, failure to yield the right-of-way, etc.  In particular, driving while intoxicated by drugs or alcohol would constitute negligence per se and often leads to potential punitive damages (damages intended to punish the wrongdoer and deter the wrongdoer and others from similar wrongful conduct) as well as actual (“compensatory”) damages.
